A and B, each of whom shall be punished by a fine of KRW 3,000,000, and Defendant C shall be punished by a fine of KRW 1,000,000.

Punishment of the crime

1. 피고인들의 공동 범행 피고인들은 2017. 9. 12. 00:10 경 서울 강동구 E에 있는 ‘F’ 주점에서 함께 술을 마시던 중, 피고인 B과 피해자 G(32 세) 가 위 주점 화장실에서 손을 씻는 과정에서 물이 튄다는 등의 이유로 시비가 붙어 한차례 말싸움을 하고 자리로 돌아온 후 재차 피해자가 손가락 욕을 한다는 등의 이유로 시비가 붙어, 피고인 B은 피해자가 있는 테이블로 가 피해자의 머리채를 잡아 흔들고, 피고인 A은 이에 가세하여 피해자의 머리채를 잡고 흔들었으며, 피고인 C은 그곳 테이블에 있던 맥주 컵 등을 피해자에게 집어던졌다.

Accordingly, the Defendants jointly assaulted the victim.

2. 피고인 A, 피고인 B의 공동 범행 피고인들은 2017. 9. 12. 00:35 경 위 F 주점에서 ‘ 싸움이 났다’ 는 112 신고를 받고 출동한 H 지구대 소속 경위 I이 피고인 A을 현행 범인으로 체포하여 연행하자, 순경 J에 의해 현행범인 체포되어 I을 뒤따라오던 피고인 B은 위 I의 등을 발로 2회 걷어차고, 피고인 A은 I의 허벅지와 종아리를 3회 걷어찼다.

Ultimately, the Defendants conspired and interfered with the legitimate execution of duties of police officers concerning the prevention and investigation of crimes.

3. Defendant C’s sole crime committed an act of assaulting G with the date, time, place, as described in paragraph (1) as above, and thereby damaging property by destroying the unfolded cloak cup and the instant market value, which is owned by the victim K, to G.
