1. The defendant shall calculate the amount of KRW 35,200,000 to the plaintiff at the rate of 15% per annum from March 4, 2016 to the day of full payment.

Comprehensively taking account of the purport of the entire arguments in Gap evidence Nos. 1 and 2, on February 14, 2015, the Plaintiff had the construction period for the Changho Construction among the extension works of the Daegu North-gu C convalescent Hospital, Daegu-gu, the Defendant performed by the Defendant, from January 19, 2015 to the same year.

5. As of the end of 31. The fact that the subcontract was executed by setting the construction cost as KRW 68,200,000 (including surtax), and the Plaintiff may recognize the completion of the said construction work within the said construction period.

Therefore, the defendant is obligated to pay to the plaintiff 3,00,000 won remaining after subtracting the amount of KRW 33,00,000,000, which the plaintiff received from the defendant, and damages for delay calculated at the rate of 15% per annum under the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings from March 4, 2016 to the date of full payment, as the plaintiff seeks.

Therefore, the plaintiff's claim is justified and it is so decided as per Disposition.
