A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

[Basic Facts] The Defendant, as well as C’s representative director C of Company B established for the purpose of solar power generation projects and the Dong, used the E-ho office located in the D apartment shopping district in the Jeon-Eup, Jung-gu, Jung-gu, Seoul, to assist C in the affairs of authorization and permission, such as receipt of an application, and to receive fees therefor, and suggested C to distribute half of the profit from solar power generation projects to the Seocho on August 2017, but C refused this.

【Criminal Facts】

1. On May 2017, the Defendant of the crime of interference with business entered into a contract on behalf of the victim B representative director C to prepare civil engineering permission documents, such as permission for development and farmland diversion, with respect to H and Jung-Eup Si I operating G in the name of representative director C of the victim B for solar power generation projects, upon the request of the above C, with the view to obstructing the application for permission for development of the above land related to solar power generation projects between C and C as above.

Accordingly, the defendant stated the facts charged in November 2017 on September 26, 2017.

However, considering that the date of application on each document that P had been kept in custody was November 2017 and the date of issuance of a certificate of the personal seal impression on October 23, 2017, the Defendant appears to have received documents from H around November 2017.

The facts in G Office F in Jung-Eup did not have received the request from C to receive the application for permission for development activities instead of the application therefor, and even if there was no idea to receive the application for permission for development activities in the regular Eup, H provided that “C and all of the problems have been resolved smoothly with each other. I change documents related to the permission for solar development in the regular Eup city. I will accept the application for permission for development activities and the permission for solar power generation business from H to the regular Eup.”
