A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On August 23, 2016, the Defendant was issued a summary order of KRW 2 million with a fine of KRW 1 million at the Seoul Western District Court on August 23, 2016, and a summary order of KRW 6 million with a fine of KRW 1 million with respect to a violation of the Road Traffic Act at the Pyeongtaek District Court on October 19, 2016, respectively.

1. Around August 31, 2018, the Defendant was driving D Szzzki Or under the influence of alcohol concentration of about 0.121% from a section of approximately 600 meters from the front of Yongsan-gu Seoul to the front of Yongsan-gu Seoul, Yongsan-gu, Seoul, while under the influence of alcohol content of about 0.121%.

2. 도로교통법위반(음주측정거부) 피고인은 전항 기재 일시, 장소에서, 안전모 미착용 운전 행위에 대하여 단속 중인 서울용산경찰서 소속 경위 E, 경장 F으로부터 피고인에게서 술 냄새가 나고 동공부가 약간 충혈되어 있는 등 술에 취한 상태에서 운전하였다고 인정할 만한 상당한 이유가 있어 약 20분간에 총 6회에 걸쳐 음주측정기에 입김을 불어넣는 방법으로 음주측정에 응할 것을 요구받았음에도 음주측정기에 입김을 불어넣는 시늉만 하거나 음주측정이 되지 않을 정도로 짧은 호흡만 불어넣는 방법으로 이를 회피하여 정당한 사유 없이 경찰공무원의 음주측정 요구에 응하지 아니하였다.
