1. On November 7, 2013, the Korea Appraisal Board Co., Ltd., a business trustee of the defendant, is golded in 2013 Sung-nam Branch of Suwon District Court.
Reasons
1. Facts of recognition;
A. The Defendant: (a) on May 12, 201, the urban planning (road) business and the B-Establishment Business (hereinafter “instant business”) business on May 12, 201; and (b) the Korea Appraisal Board G.
C Public notice of project approval (public notice of approval of implementation plan) as to Hanam-si, and D land (hereinafter “D land”) as to Hanam-si.
2) On July 7, 201, the land was divided from D on July 7, 201 and was expropriated for the instant project.
3) Since the land D was jointly owned by F and G in 1/2 shares, E was also owned by F and G. 4) The Korea Appraisal Board, Inc., the Defendant, a trustee of the Defendant, was unable to obtain consultation on the shares of G out of the land E, and deposited KRW 124,560,750 (hereinafter “the instant deposit”) with the Suwon District Court Sung-nam Branch Co. 3631 on November 7, 2013, as the amount of KRW 124,560,750 (hereinafter “instant deposit”).
B. G registration of the D land 1) H is the land of the Hanam-si I (hereinafter “I land”) located before the land is divided into D land.
The residents of the village in the above land owned the land, but the owner of the land and the building had been different by constructing a building on the ground owned by H. 2) The village residents formed the Land Purchase Promotion Committee around 1973 and promoted the purchase of I land and the land on its own from H.
Land purchase promotion committee was donated to H by requesting the Plaintiff to donate the land for the passage of village residents other than the exclusive area for the ownership of each village resident's house.
3 With respect to the name of the above land, H is the JJ Day, and it is the land donated by JJJ Day, and it is necessary to use this land for the road use of village residents, and thus, it was registered under the name of "G".
D It is also said that the shares in G in the land are partially owned.
