A defendant shall be punished by imprisonment for not less than eight months.
Seized evidence 1 to 11 shall be confiscated.
Reasons
Punishment of the crime
The defendant purchased smartphones, etc. at low prices, which are stolen, and resells them into Chinese mobile phone dealing organizations.
1. Acquisition of stolen property;
A. On July 23, 2013, at around 21:00, the Defendant: (a) contacted the Defendant that he would sell smartphones on the street near the naval land located in Seo-gu Daejeon, Seo-gu, Daejeon; (b) purchased smartphones at KRW 7,00,00,000 and acquired stolen goods with knowledge of the fact that it was a 7,000,000 won of smartphones owned by the victim E, which he stolen.
B. On July 26, 2013, around 15:30, the Defendant acquired stolen goods by purchasing DNA and F, which he/she found in the street near the Incheon Central Terminal located in the Nam-gu Incheon Metropolitan City, Nam-gu, Incheon, with knowledge that it was seven million won of smartphone, the market price of the victim G owner who was stolen by him/her, was 2.66 million won.
C. On July 27, 2013, around 07:00, the Defendant acquired stolen goods by purchasing 27 million won of smartphone 27 million won, even though he/she knew of the fact that the victim J owned by D and F, in the same manner as the preceding paragraph, he/she stolen from D and F, using the same method as that of the preceding paragraph.
On July 29, 2013, at around 15:00, the Defendant acquired stolen goods after being aware of the fact that the smartphone price in the victim J owned by D and F was 7,000,000 won, such as the preceding paragraph, in front of the luminous 21, a luminous Lighting Station in light of the luminous Lighting Station, which he stolen from D and F.
2. On July 10, 2013, the Defendant violated the Road Traffic Act (unlicensed driving) without obtaining a driver’s license on a total of six occasions on July 10, 2013 and on August 4, 2013, and driving the HG car at the Seoul, Gyeonggi, North Korea, and Daejeon.
