1. Facts of recognition;

A. The Plaintiff is a legal entity that runs the business of inviting and operating Korean-style franchise stores, and the Defendant is an individual entrepreneur who operated a general restaurant in the name of Yeonsu-gu Incheon Metropolitan City C in the name of “D.”

B. On March 29, 2016, the Plaintiff entered into a franchise agreement with the Defendant with the franchiser and the Defendant as the franchisee for the franchise business of “D” Incheon Training Point franchise business.

C. Article 15 of the above franchise agreement provides for KRW 5,50,000 for the first amount to be paid by a franchisee to a franchisor, KRW 2,200,00 for the first educational expenses, KRW 1,000 for the contract performance guarantee, and KRW 1,000 for the contract performance guarantee, and Article 17 provides for the amount equivalent to KRW 3.3% of the monthly sales if only an exclusive product is supplied, and KRW 1.1% of the monthly sales if a franchisee is supplied with all logistics, such as exclusive products, solicitation products, alcoholic beverages, etc.

As of November 15, 2017, the franchise fee, such as royalties and goods that the Plaintiff is obligated to receive from the Defendant according to the above franchise agreement, is the sum of KRW 8,16,897 as follows:
