피고인은 2013. 6. 25. 11:50경 서울 노원구 B아파트 108동 놀이터 벤치에서 피고인이 성명 불상의 여자에게 욕설을 하는 것을 그곳을 지나가던 피해자 C(여, 52세)가 목격을 하고 제지하자 피해자에게 자신의 배낭 속에 있던 과도칼(칼자루 길이 10.5cm, 칼날 길이 8.5cm)을 꺼내들어 '너는 누구나 씨발년아, 칼로 내배를 찔러라, 요즘 돈도 없는데 잘됐네, 깽 값 한번 물어봐라"라고 소리쳐 피해자에게 공포감을 주는 등 피해자를 협박하였다.
