1. The summary of the case and the facts premised on the case

A. The summary of the instant case pertains to the Plaintiff’s claim against the Defendant for compensation for losses due to a decrease in the price of remaining land based on Article 73 of the Act on Acquisition of and Compensation for Land, etc. for Public Works Projects (hereinafter “Land Compensation Act”), alleging that the land owned by the Plaintiff was partially expropriated due to the execution of the railroad construction project, which is the Defendant’s public works project, and the price of remaining land remaining after expropriation due to the implementation of land expropriation and the implementation of the railroad construction project following the said project has decreased.

The judgment of the court of first instance accepted the plaintiff's claim on the ground that the plaintiff's decline in value has occurred due to the land expropriation by the defendant, and the defendant appealed against this.

⑵ 원고 소유 토지의 수용과정 ㈎ D 건설사업은 토지보상법 73조, 토지보상법 시행규칙 32조에 기초하여 2012. 11. 6. 국토해양부 고시 E, 2013. 6. 4. 국토해양부 고시 F의 실시계획 고시로 사업인정이 이루어졌다.

㈏ 원고는 이천시 N 전 2,999㎡을 소유하고 있었고, 그중 일부(1,050㎡)가 이천시 R로 분할되어 피고에게 수용되었으며, 토지수용에 따른 잔여토지로 이천시 N 전 1,949㎡이 남게 되었다.
