In full view of the purport of the argument in Gap evidence No. 1, the defendant is obligated to pay to the plaintiff and C the amount of KRW 40,000,000 borrowed money of KRW 40,000 to the plaintiff of the principal debtor on June 19, 2018, as the defendant agreed on a subrogation payment of KRW 40,000 to the plaintiff of the principal debtor on December 31, 2019. Thus, the defendant is obligated to pay to the plaintiff 40,000,000 on subrogation payment and the damages for delay calculated at the rate of 5% per annum as stipulated in the Civil Act from January 1, 2020 until June 21, 2020 when the duplicate of the complaint of this case was delivered to the defendant, and from the next day to the day of full payment, 12% per annum as stipulated in the Act on Special Cases Concerning the Promotion,

The plaintiff's claim of this case is justified and accepted.
