Punishment of the crime

[전제사실] 피고인들은 E에 있는 F 3회 졸업생으로, 2020. 4. 7. 저녁경 G에 있는 H에서 모여 ‘F 후배인 I 후보(당시 J정당 K 후보자)가 당선될 수 있도록 선거를 도와주자’라는 의견을 나눴고, 이에 피고인 A는 2020. 4. 11.경부터 같은 달 12.경까지 I 후보의 제21대 국회의원선거 K 지역 당선을 위해 유력한 경쟁후보인 L(당시 M정당 K 후보자)에게 정치자금법위반 전과가 있다는 사실을 부각하는 것이 유리하다고 판단하여 ‘나도 국회의원이 꿈인데 전과사실로 접었습니다’라는 문구의 피켓(이하 ‘이 사건 피켓’이라 한다) 3개를 제작하였고, 피고인들은 이 사건 피켓을 선거구민들이 많이 지나다니는 장소에 게시하기로 공모하였다.

【Criminal Facts】

No one shall install, display, post or distribute any wreath, balloon, signboard, placard, advertising balloon, advertising tower, other advertising material or facilities, except for those prescribed by the Public Official Election Act, in order to have an influence on the election from 180 days before the election day to the election day.

1. On April 12, 2020, Defendant A posted the instant pocket ticket to assist Defendant A in the winning of I candidates in the N market near approximately 30 minutes between around 14:00 to 14:30.

As a result, the defendant posted an advertising ticket in order to influence the election.

2. As described in Paragraph 1, the Defendants’ co-principal Defendants reported that Defendant A posted the instant recipient’s ticket in the vicinity of the N market, and considered that posting the instant recipient’s ticket is a method to raise the possibility of winning the I candidate’s election. As such, the Defendants conspired to post the instant recipient’s ticket at several places.

Defendant

A and Defendant C, from April 13, 2020 to about 19:06, respectively, shall use the instant skinet in the vicinity of the O for one hour from around 18:00 to around 19:06.
