The defendant's appeal is dismissed.

1. Summary of grounds for appeal;

A. Because of erroneous determination of facts and misapprehension of legal principles, the Defendant heard the opinion that he/she would find a person who will lend his/her name for three months due to tax issues and introduced C, thereby making C to the entrance of each certified judicial scrivener office as stated in the judgment below, and the Defendant did not obtain the loan by fraud in collusion with the loan fraud group.

Nevertheless, there is an error of misunderstanding of facts or misunderstanding of legal principles in the court below which found Defendant guilty of fraud.

B. The lower court’s sentence of unreasonable sentencing (one year and six months of imprisonment) is excessively unreasonable.

2. Determination

A. As to the assertion of misunderstanding of facts and misapprehension of legal principles, the defendant also argued in the judgment of the court below that the above assertion of misunderstanding of facts was identical to the above assertion of misunderstanding of facts, and the court below argued that the defendant returned the name of the defendant and the defense counsel three months after the decision, i.e., the defendant's loan of real estate from the person who borrowed the name of C with C as collateral, and that the real estate goes beyond the proceeds through auction (in case of an investigation record 211 pages), and that the defendant is well aware of the fact that C is not able to repay the loan or pay interest specified in the facts constituting the crime in the judgment, and Ⅲ is not well aware of the fact that it did not know at all about the loan or the name lending of real estate, Ⅲ does not appear to have taken advantage of the person who borrowed the name of the defendant or prepared a written contract or loan application. However, contrary to the defendant's assertion, C is liable for the loan and interest of the defendant to the investigative agency of this case and the defendant made a loan to C as collateral.
