1. Basic facts

A. On June 27, 1997, the Plaintiff (former Life Insurance Co., Ltd.) entered into an insurance contract with the Defendant of “Class 2 of the Undividend Savings” (hereinafter “instant insurance contract”) with the following content.

Policy holders and the insured: Where the grounds for the payment of insurance proceeds are due, retirement, hospitalization, or disability, the defendant himself/herself, and where the defendant dies, the securities number of the defendant's statutory heir: the B insurance period from June 27, 1997 (as of June 27, 2007): 120,168 won

B. The terms and conditions of the insurance contract of this case and the terms and conditions borrowing agreement of this case are as follows.

◎ 보험 약관 제19조 보험료의 납입연체시 납입최고와 계약의 해지 ① 계약자가 제2회 이후의 보험료를 납입기일까지 납입하지 아니하는 때에는 납입기일 다음날부터 납입기일이 속하는 달의 다음달 말일까지를 최고기간으로 하며, 원고는 제3항에서 정한 바에 따라 최고하고 납입최고기간 안에 보험료가 납입되지 않은 경우 납입 최고 기간이 끝나는 날의 다음날 보험계약을 해지합니다.

The Company shall pay the agreed insurance money for an accident that occurs within the maximum period of payment.

(3) In cases where premiums have not been paid until the due date for the second or subsequent payment of premiums, the plaintiff shall notify in writing or by telephone that he/she should pay the unpaid premiums to the policyholder (including the specified beneficiary in cases of insurance for another person) within the payment peremptory period, and that the premiums have not been paid by the due date for the expiration of the payment peremptory period, the plaintiff shall notify in writing or by telephone that the insurance contract will be terminated 15 days before the expiration of the payment peremptory period.

Article 20 (1) Reinstatement of a termination contract is terminated pursuant to Article 19, but where no refund for cancellation is paid, the contractor shall be determined by the plaintiff within two years from the date of termination.
