1. All of the plaintiff's claims are dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Basic facts

A. On September 25, 2014, the Plaintiff filed a lawsuit against C with Busan District Court 2014Da75253, the Plaintiff filed a claim for the purchase of goods. On January 29, 2015, the said court rendered a favorable judgment in favor of the Plaintiff: “C shall pay to the Plaintiff KRW 55,122,00 and the amount equivalent to 6% per annum from September 28, 2011 to November 22, 2014; and the amount equivalent to 20% per annum from the next day to the date of full payment.” The said judgment was finalized on April 20, 2017 following the appeal and final appeal by C.

B. On the other hand, on June 20, 2014, C entered into a sales contract between C and the Defendant with respect to the real estate listed in the separate sheet (hereinafter “instant real estate”) on which it owns the purchase price of KRW 76,00,000 (hereinafter “instant sales contract”) and the purchaser entered into the sales contract as K, in light of the fact that the purchaser entered the contract as the Defendant’s child, K appears to have actually entered into the instant sales contract with C as the Defendant’s agent;

In addition, regarding the instant real estate, the Defendant completed the registration of transfer of ownership in the purport of the claim based on the sale.

C. C’s property status 1) At the time of the instant sales contract for active property: ① The instant real estate in an amount equivalent to KRW 100,000,000 at the market price; ② on January 31, 2015, sold to D sales amounting to KRW 450,000,000, the Eresh concrete slab roof 3 floors, neighborhood living facilities, and accommodation facilities (Felel; hereinafter “Fel”).

(3) On July 2013, 201, G purchased KRW 254,00,000 from G around July 2013, North Korea-gu H apartment Nos. 104, 1901 (hereinafter “H apartment”).
