1. Defendant B: (a) on February 3, 1978, on the part of the Plaintiff with respect to the size of 2,386 square meters in Gangdong-gu Seoul Metropolitan Government C Forest Land.

1. Basic facts

A. On January 16, 1978, the Plaintiff entered into a pre-sale agreement and provisional registration between the Plaintiff and the Defendant B, and the land indicated in paragraph (1) of the disposition (hereinafter “C land”).

(3) On February 3, 1978, Defendant B, on the same day, completed the registration of ownership transfer under the name of the above Defendant in subrogation of E, who is the owner at the time of February 3, 1978, and completed the registration of ownership transfer under the name of the above Defendant. On the same day, the provisional registration based on the preservation of the right to claim ownership transfer based on the instant trade reservation (hereinafter “the provisional registration of this case”).

B. B. On February 3, 1978, the ownership transfer registration was completed in the name of Defendant B on the register of land C, and on May 24, 1982, the registry was closed on the ground that substitute land was not issued in accordance with Articles 49 and 50 of the Land Readjustment Projects Act.
