A defendant shall be punished by imprisonment for one year.
Reasons
Punishment of the crime
On January 25, 2017, the Defendant was sentenced to two years of imprisonment for fraud at the Incheon District Court, and the judgment became final and conclusive on February 2, 2017.
1. The Defendant and C, in the course of committing the act of financing workers’ lease of housing, are those soliciting false lessors to obtain the loan of housing lease; D is those soliciting false lessees; D is those soliciting false lessors, false lessors, false names, and those soliciting false lessees; and “F” and “G” are all those soliciting false lessees.
The Defendant and the above C, etc., in the case of a housing lease loan system operated by the National Housing Fund as a financial source for the housing stability of homeless workers in the Ministry of Land, Infrastructure and Transport, based on the circumstances that, without any special security, they could easily obtain a loan by submitting documents related to the employment of the National Housing Fund and a house lease contract to financial institutions without any specific security, by making a false house lease contract as if they were to have entered into a housing lease contract with a false lessee and actually entered into a housing lease contract between them, and by making a false house lease contract form and submitting the documents related to the employment contract form and the documents related to the employment which were made by fraudulent means
Accordingly, around April 2014, the defendant introduced C to request C to introduce a person who will serve as a lessor of a false house lease contract, and C introduced E. The defendant again introduced E to the above F andG "."
On the other hand, on April 7, 2014, the above D obtained false employment certificates, income tax collection receipts, etc. recorded as “H”’s employee, although it did not have worked as “H” employee from a person in the name disorder, and then entered “Y and 102 Seoul Metropolitan Government Housing” in the J Certified Private Brokerage Office located in Yangcheon-gu Seoul Metropolitan Government I as “Y and 120 million won, lessor E, and lessee D” in relation to “Y and 100 million won” in the J Certified Private Brokerage Office around April 7, 2014.
