Reasons
Punishment of the crime
1. Joint crimes with B [Interference with auction] The relationship with the Defendant and B, and the Defendant, at the request of an interested party to the auction case in progress, are the so-called “auction hub” which delays the auction procedure by reporting false lien to the court, or causes the lower price of the auction object to be awarded a successful bid.
B: (a) On February 5, 2014, the person who actually owns and manages, in the name of H, the spouse of Hongsung-gun, Hongsung-gun, D, E, and F (hereinafter collectively referred to as “G land”), and (b) around February 5, 2014, the person holding a right to collateral security was registered as a joint collateral security establishment with H and the maximum amount of the claims KRW 190 million with the application for voluntary auction by the Daejeon District Court on August 11, 2015.
B tried to sell G land to another person in return for the payment of the secured debt of the right to collateral security, thereby suspending the above voluntary auction. However, while the applicant for the purchase of G land was not found, the Defendant introduced the Defendant from K during the period of not finding the applicant for the purchase of G land. The Defendant and B attempted to delay the auction procedure of the above G auction case until the applicant for the purchase appear at the Defendant’s M office located on the first and second floor Seoul Dongdaemun-gu L and the second floor on January 2016. The Defendant and B attempted to offer 30,000 won as the expense and pay the Defendant a honorarium of two million won.
Criminal facts
A. On May 23, 2016, according to the above conspiracy, the Defendant was a juristic person that had not executed construction works on G land and did not have a lien in relation to the case of voluntary auction at the Daejeon District Court's red support auction office located in Hongsung-gun, Hongsung-gun around May 23, 2016.
