1. The defendant shall deliver to the plaintiff Cheong forest Co., Ltd. the movables specified in Paragraph 2, among the descriptions of attached Form 1 movable property.

1. Basic facts

A. On January 21, 2013, the Asia Savings Bank (hereinafter “ASEAN Savings Bank”) completed the registration of establishment of a neighboring factory site B 2,771 square meters and its ground factory buildings, etc. (hereinafter “instant factory”) in the official city owned by Cheongm Industrial Co., Ltd. (hereinafter “Cheongm Industrial Co., Ltd.”). During that process, the registration of establishment of a neighboring mortgage (hereinafter “instant mortgage”) was completed with respect to machinery installed in the instant factory based on the Factory and Mining Foundation Mortgage Act (hereinafter “factory Mortgage Act”). The list of machinery and tools of the instant mortgage is as stated in the detailed statement of appraisal of machinery and instruments in attached Form 2 (hereinafter “instant machinery”).

B. C Co., Ltd. (hereinafter “C”) leased part of the instant factory from the so-called “Cheongm Industry” on July 11, 2013.

On July 31, 2013, the Asian Savings Bank filed an application for voluntary auction on the instant factory and collateral security machinery, etc. with the Daejeon District Court’s official branch office, based on the instant collateral security, and received a decision to commence voluntary auction (D and the auction procedure following the said decision to commence voluntary auction (hereinafter “instant auction procedure”) from the said court.
