1. The Defendant is based on the termination of title trust on September 2, 2015 with respect to the motor vehicles listed in the separate sheet from the Plaintiff.
Reasons
1. According to the overall purport of Gap evidence Nos. 1, 2, and 4 as to the cause of the claim, it is recognized that the defendant purchased a motor vehicle listed in the separate sheet on March 30, 2006 (hereinafter "the instant motor vehicle"), registered transfer of ownership in the name of the plaintiff, and agreed with the plaintiff to complete transfer of ownership in the name of the defendant.
On September 2, 2015, the Plaintiff’s delivery of a copy of the instant complaint to the Defendant, and the fact that the title trust agreement was terminated is apparent in the record. Therefore, barring any special circumstance, the Defendant is obligated to take over the transfer of ownership registration procedure for the instant automobile on September 2, 2015, to the Plaintiff on the ground that the title trust was terminated.
2. The defendant's argument that the procedure for the registration of transfer of ownership cannot be taken over before the cancellation of the seizure of the motor vehicle of this case due to the plaintiff's national tax and local tax, but the above circumstances cannot affect the defendant's obligation to take over the transfer of ownership, and the defendant's above argument is without merit.
3. If so, the plaintiff's claim is justified and it is so decided as per Disposition.
