1. The Defendant’s KRW 63,00,000 as well as the Plaintiff’s annual rate of KRW 5% from February 9, 2017 to May 21, 2019.
Reasons
1. Basic facts
A. From around July 2016, the Plaintiff has been operating a loan by using the operating funds necessary for companies importing, storing, and distributing meat from around 2016, as a collateral for the goods kept in securities or freezing warehouses, and C is serving as the representative director of the Defendant from around July 24, 2014.
B. The Plaintiff received a loan from a lending broker, and entered into a security agreement and a monetary loan agreement for the land to the lender, which is a goods distribution company, and received a written confirmation of transfer from a warehouse that keeps imported land like the Defendant.
C. D and E entered into a credit transaction agreement with a financial institution and received a loan by providing imported meat as a collateral in the course of operating multiple imported meat distributors. C concluded a freezing use agreement with a financial institution on behalf of the Defendant, including the Plaintiff, while keeping imported meat in custody at commission from an imported meat distributors, and issued a “transfer certificate”, which is a document to the effect that, if imported meat distributors receive a loan of collateral as collateral from a financial institution, the ownership of the collateral is changed from the imported meat distributors to the financial institution as the secured party, and the secured party keep the collateral in the freezing storage for a financial institution as the secured party.
Article 2 (Goods in Custody) The goods stored under this Agreement shall be the freezing livestock products. If the expiration of the distribution period, or if the goods prohibited from being stored in the relevant Acts and subordinate statutes, such as Food Sanitation Act and the Processing of Livestock Products Act, or the goods in violation of the Acts and subordinate statutes or the public order and good customs, any damage shall be compensated in full, and if the goods are shipped out, they shall be shipped out for the purpose of disposal.
