1. Basic facts

A. On May 17, 2013, the Plaintiff concluded the following sales contracts with the Defendant, selling C, D, E’s building site and the above C, D ground reinforced concrete structure D’s retail stores and offices, and one story 231.18 square meters (retail stores), 228.30 square meters (retail stores), 228.30 square meters (retailers), 228.30 square meters (retailers), 228.30 square meters (retailers), 228.30 square meters (retail restaurants), and 228.30 square meters (hereinafter referred to as “instant building”; when referring to each land and building, hereinafter referred to as “instant real estate”).

C. On April 3, 2013, H applied for compulsory auction on the instant real estate, and the decision to commence compulsory auction was rendered to Suwon District Court L on April 3, 2013, and the registration of the decision to commence compulsory auction was completed under Article 51678 on the same day, and the registration of the decision to commence compulsory auction was completed as of July 1, 2013 by the same registry office as of July 1, 2013.
