Reasons
Punishment of the crime
[2015 High 2443] The Defendant is the actual manager of G in Geumcheon-gu Seoul Metropolitan Government F (1st floor) who ordinarily employs six workers and operates food business.
Defendant (hereinafter “Defendant”) retired from the said workplace as from May 11, 2015 to June 13, 2015, including H’s wage 2,370,970 won on May 5, 2015, and wage 1,63,30 won on June 6, 2015, total of KRW 4,004,30 on June 1, 2015, and the list of crimes in attached Form.
1. As described above, the retirement worker did not pay the total of 18,722,870 won within 14 days from the date of retirement without agreement between the parties on the extension of the due date for payment.
[2015 High 244] The Defendant is a person who is a real manager of G Co., Ltd. in Geumcheon-gu Seoul Metropolitan Government F (1st floor) and operates a service business using 15 full-time workers.
Defendant-based (i) retired from the said workplace from March 5, 2015 to August 2, 2015; (ii) paid 2,613,360 won on June 6, 2015; (iii) wages of 3,700,000 won on July 7, 2015; and (iv) wages of 238,710 won on August 8, 2015; and (iii) wages of 6,52,070 won on retirement from August 8, 2014 to August 2, 2015; and (iv) the J-based retired from office did not pay 800,000 won on June 8, 2015; (iv) wages of 2,200,000 won on July 7, 2015; and (v) 3,000,000 days on retirement from the date of the agreement between the parties to the payment.
[2016 High 407] The Defendant is the actual representative of K in the first and second floors underground of the Geumcheon-gu Seoul Metropolitan Government, who is engaged in the service business using nine full-time workers.
Defendant 1 had worked from April 13, 2015 to June 12, 2015 at the same place of business, and had not paid 1,200,000 won for May 5, 2015, and the total of 1,680,000 won for June 6, 2015, and 1,680,000 won for the payment period between the parties without agreement on the extension of the payment period between the parties.
[2016 High 408] The Defendant is a real manager of G Co., Ltd. in Geumcheon-gu Seoul Metropolitan Government F (1st floor) and operates a service business by employing 15 full-time workers.
