1. Basic facts

A. The Plaintiff is an insurer who has entered into an automobile insurance contract (hereinafter “instant insurance contract”) with respect to D's D's Sheet No. C (hereinafter “Plaintiff”) and the Defendant is a mutual aid insurer who has entered into an automobile mutual aid contract with respect to E's rocketing taxi (hereinafter “Defendant”).

Around 20:00 on August 30, 2018, the Defendant’s vehicle traveling along a private street crossing that does not regulate the traffic of nearby the Seoul Gwanak-gu Seoul Special Metropolitan City F, along the direction from the university road to the Gsiwon, passed the said intersection. In accordance with the instant insurance contract, the Plaintiff paid insurance proceeds of KRW 3,042,890 in total, including KRW 2,026,330, and KRW 1,016,560, and the agreed amount of KRW 1,042,890, to the Plaintiff driver C of the Plaintiff, who suffered injuries, such as satise satis, tension, etc., from October 17, 2018 to January 25, 2019. ② From September 12, 2018 to January 25, 2019, the Plaintiff paid insurance proceeds of KRW 2,202,20,000, including the agreed amount of KRW 478,00,00, and KRW 2,202,20.

On September 17, 2018, the Plaintiff deducted KRW 500,000 from the insurance contract in the instant case, and paid KRW 5,078,00 as the repair cost for the Plaintiff.

2. The parties' assertion

A. On the summary of the Plaintiff’s grounds of appeal, the intersection where the instant accident occurred is an intersection where traffic is not controlled, and the Plaintiff’s vehicle is the right side of the road.
