Punishment of the crime
The Defendant is a person who was operating the “E”, a plastic manufacturing company located in D when it is commercialized.
around July 13, 2011, the Defendant concluded a lease agreement with the victim capital stock company at the G office located in Nam-gu Incheon Metropolitan City, with the content of the lease amounting to KRW 12,540,36 months, monthly lease amounting to KRW 3,626,476, on the private capital stock company, LSH-130D-W-1, LH-220D-W-1, LH-220D-1, which was owned by the victim capital stock company. In order to secure the payment of the above lease fee, the Defendant agreed to provide the victim with the ownership of the transferred property for transfer to the company by establishing the lease agreement with the victim.
In addition, on April 26, 2013, the Defendant entered into a lease agreement with the amount of KRW 330,300,000 won, the lease period of KRW 48 months, monthly lease amount of KRW 6,627,080 with respect to the amount of KRW 3 of LGE110 Class 3 of LGE 3 of LGE10, which is owned by the victim two capitals Co., Ltd., the Defendant agreed that the ownership of the leased object exists in the victim company.
1. Around April 16, 2013, the Defendant embezzled: (a) sold lsH-130D-WX 1; (b) lsH-220D-WX 1, which is a leased object, to a string buyer without the consent of the string company of Korea; (c) sold 55 million won to a string buyer; (d) around June 16, 2013 at the same place; and (e) without the consent of the string company of LGE110-W-X 3, which is a leased object, at the same place; and (e) embezzled the victims’ property by selling 120 million won to H.
2. Although there was a duty not to unfairly reduce the value of the security by disposing of the above machinery, etc. offered as security for transfer to the victim Korean Capital Co., Ltd., the Defendant provided the said security as security for transfer in violation of his/her duty, and in violation of his/her duty, Kim Jong-si, Kim Jong-si, 1 as above.
