A defendant shall be punished by imprisonment for a period of five months.

Provided, That the execution of the above punishment shall be suspended for two years from the date this judgment became final.

Punishment of the crime

[2014 Highest 3046] The defendant is a representative of the corporation corporation, the head office of which is located N in Nam-si, and an employer who runs wholesale and retail business of agricultural products using 48 above workers.

1. The Defendant in arrears with wage payment related to workers who work at the store in the lot training place was employed from February 7, 2013 to November 16, 2013 at the store in the training place in Yeonsu-gu, Yeonsu-gu, Incheon, Yeonsu-gu, and did not pay 4,280,000 won in total of two workers’ wages within 14 days from the date of retirement without agreement on the extension of the due date between the parties, as stated in the attached Table Nos. 5 and 6, including the amount of wages 2,280,000 won in October 7, 2013.

2. Wages and retirement allowances in arrears related to workers who work at a store in a lot line;

A. The Defendant, as indicated in the [Attachment 2] List of Crimes (2) No. 1,880,000 won (including the amount of wages of Q from May 18, 2006 to May 10, 2013, who retired from the said store located within the 159-1, 159-1, Seo-gu, Busan, Seo-gu, Incheon, was working in the said store within the 159-1, 200. The Defendant did not pay 2,80,000 won for the total wages of two workers within 14 days from the date of retirement without an agreement between the parties on the extension of the due date between the parties.

B. The Defendant, while working in the instant store located in a lot line, from December 18, 2006 to May 10, 2013, and retired from Q’s retirement allowance of KRW 6,827,865, was not paid within 14 days from the date of retirement without agreement between the parties on the extension of the due date for payment, as stated in attached Table 2(2) No. 1,3,4,5,7, as well as attached Table 36,693,049, total sum of five employees’ retirement allowances, as stated in attached Table 2(2).

[2015 Godan1184] The Defendant is an employer who employs 40 full-time workers from N in Nam-si and operates O of the corporation.

1. When a worker retires, the employer in violation of the Labor Standards Act shall pay the wages, compensations, and other money or valuables within fourteen days thereafter;
