1. As to the Plaintiff, Defendant A and B, jointly and severally, KRW 89,457,954 and KRW 88,773,809, among them, shall be jointly and severally filed against the Plaintiff.

1. Basic facts

A. 1) The Plaintiff entered into a credit guarantee agreement on June 27, 2008, the Defendant A Co., Ltd. (hereinafter “Defendant A”).

B. The Defendant A’s performance of the guaranteed obligation and acquisition of the claim for reimbursement; 1) Defendant A’s guarantee issued under the credit guarantee agreement of this case, as security, is Samsung Electronic Co., Ltd. (hereinafter “Tsung Electronic”).

(2) On November 20, 2013, the Changwon District Court rendered a provisional attachment order No. 2013Kadan4119 (hereinafter “instant real estate”) against the real estate listed in the separate list owned by the Defendant A (hereinafter “instant real estate”) around KRW 100 million.

3) 원고는 이 사건 신용보증약정에 따라 2014. 6. 20. 삼성전자에 89,192,979원을 대위변제하여 보증채무를 이행하고, 법적절차비용 684,008원을 지출하였다가 그 중 419,170원을 회수하였다. 위 회수금 419,170원에 대한 대위변제일로부터 회수일까지의 손해액은 137원이다. 다. 근저당권설정 1) 피고 주식회사 지아이에스네트웍(이하 ‘피고 지아이에스네트웍’이라 한다)과 피고 A는 2014. 5. 9. 피고 A의 유일한 재산인 이 사건 부동산에 관하여 채권최고액 32,000,000원, 채무자 피고 A, 근저당권자 피고 지이아에스네트웍으로 하는 근저당권설정계약을 체결하고, 서울남부지방법원 영등포등기소 2014. 5. 9. 접수 제20508호로...
