A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On December 14, 2018, the employees of the Singishing operations conspired to make a loan to the victim D by calling to the victim D. On or around December 14, 2018, the employees made a false statement that “I will make a loan to the E-bank. On the other hand, as the deposit is required to be notified by us, deposit KRW 480,000 in the account

However, the person who is not aware of the fact did not have the intent or ability to provide the loan to the victim, and was intended to obtain the money from the victim.

As such, the person who was unaware of the name was accused of the victim, and that person received 480,000 won from the victim to the post office account (F) in the name of the defendant on the same day.

The Defendant, as above, withdrawn KRW 480,00,00 which the victim remitted on the same day, and remitted the money to the numberless account known to the winners of the name in order to assist the Defendant in committing the aforementioned telephone financial fraud.

Accordingly, the defendant, by facilitating the telephone financial fraud crime of a person who has not received a name, assisted it.

2. Unless otherwise specifically provided for in any other Act, any person who violates the Electronic Financial Transactions Act shall transfer or acquire the means of access to any third party, or shall lend the means of access to any third party upon receiving, demanding or promising any compensation.
