A defendant shall be punished by imprisonment for not less than two years and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

1. 정보통신망이용촉진및정보보호등에관한법률위반(음란물유포) 피고인은 2013. 4. 28. 10:47 청주시 상당구 C, 201호(D)에 위치한 피고인의 주거지에서, 자신이 사용하는 휴대전화로 채팅 앱 ‘즐톡’에 접속한 다음 자신을 18세 여성으로 설정한 E와 채팅을 하다가 자신의 성기가 촬영된 사진을 전송한 것을 비롯하여 그 무렵부터 2013. 5. 4. 22:40까지 별지 범죄일람표(Ⅰ)과 같이 총 16회에 걸쳐 성기가 촬영된 음란한 사진을 타인에게 전송하였다.

Accordingly, the Defendant distributed obscene images via information and communications networks.

2. 아동청소년의성보호에관한법률위반(음란물제작배포등) 피고인은 2013. 4. 30. 14:06 위 제1항 기재 피고인의 주거지에서 자신이 사용하는 휴대전화로 채팅 앱 ‘즐톡’에 접속한 다음 자신을 19세 여성으로 설정한 여성청소년 성명불상자와 채팅을 하다가 그녀의 음부가 노출된 사진을 촬영하도록 시키고 이를 전송받아 휴대전화에 저장한 것을 비롯하여 그 무렵부터 2013. 5. 4. 14:19까지 별지 범죄일람표(Ⅱ)와 같이 총 9회에 걸쳐 여성청소년으로 하여금 음부, 가슴 등이 노출된 사진을 찍어 보내도록 시켜 이를 전송받아 휴대폰에 저장하였다.
