1. The Defendant shall repurchase the Plaintiffs on July 8, 2014 with respect to each/2 share of 1/2 of the remaining-gu C Forest land of 1,245 square meters at the time of port.

1. Basic facts

A. The remaining land of this case and D forest land of 1,245 square meters (hereinafter “D land”) were incorporated into a site subject to the project to open access roads located in Nam-gu, Nam-gu, Si/Gun (hereinafter “instant road construction project”), in which the Plaintiffs owned one-half shares, and the Defendant acquired each of the above land through consultation on June 25, 2004 pursuant to the Act on Acquisition of and Compensation for Land, etc. for Public Works (hereinafter “Public Works Act”), and completed the registration of ownership transfer under the Defendant’s name on the same day.

B. The Defendant completed the construction of access roads to D land in around 2007 (hereinafter referred to as the “instant road”). However, the instant land was left alone without the construction of the road.

C. On September 8, 2009, the Defendant, including the Plaintiffs whose land was acquired through consultation, received a civil petition on the entire owner of the instant land adjacent to the instant road, which was acquired through consultation with the Marine Corps headquarters, which was an agency affiliated with the Defendant, for the construction of the instant road, but did not actually construct a road, to repurchase the neglected land. On September 29, 2009, the Marine Corps Commander received a civil petition with the purport that “The Marine Corps Commander will first examine the efficient measures for the development of a unit in connection with the F Modernization project on the remaining land after the construction of the instant road,” which is called “The Marine Corps Commander will first examine the effective measures for the development of a unit in connection with the F

On July 2, 2013, A and five others filed a civil petition with the content of demanding the redemption of the instant land at the National Examination Board, and the same year.

8. 21. The head of the border facility headquarters of the Ministry of National Defense, which is an institution affiliated with the defendant, is scheduled to conduct a divisional survey on September 2013 because the remaining site outside of the road site of this case is not divided, and if public records are arranged after the completion of the survey, it shall be repurchased within the year after approval by the Ministry of National Defense in accordance with the comprehensive management plan of State property.
