A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

On July 26, 2018, the Defendant was sentenced to six months of imprisonment for fraud in the Daegu District Court Kimcheon Branch on July 26, 2018 and completed the enforcement of the sentence in the Daegu Detention House on January 20, 2019.

1. At around 08:00 on January 22, 2019, the Defendant, despite having no intent or ability to pay the amount of fact in the “D” restaurant operated by the victim C in the Gu and America, was committed as if he would normally pay the amount. The Defendant ordered food and received food equivalent to KRW 31,000,000 from the employee E and received food equivalent to the total amount of KRW 31,00,000 from the employee E.

2. On February 6, 2019: (a) around 04:18, the Defendant received food equivalent to KRW 15,000, total sum of 2 bottles from employees I in the “H” restaurant operated by the victim G in the Guro-si F, in the same manner as that set forth in paragraph 1, from the employee I in the manner as described in paragraph 1.

At around 07:00 on February 6, 2019, the Defendant: (a) was active as if he would normally pay the actual fare in front of the Dondong community center located in Don-ro 12-gil 12-gil, Nowon-gu, Seoul; (b) was on the Don-si operated by the injured party J and had the injured party operate a taxi to the “Mat-si” located in the Gunmi-si; and (c) did not pay KRW 13,200 on the Don-si; and (d) obtained pecuniary benefits equivalent to the same amount as

At around 02:00 on February 8, 2019, the Defendant acquired food equivalent to KRW 49,00,000, which is the sum of one person, two diseases, and one rhyth of a gym from the victim, in the manner described in paragraph 1, at the “P” restaurant operated by the victim O located in the Gu, Si, Si, Si, Gu, and Gu.

5. At around 15:00 on February 8, 2019, the Defendant received excreta tax amounting to KRW 20,000 by being provided from the victim with food equivalent to KRW 20,00,00 in a “S” restaurant operated by the victim R in the Gusisi Q, as described in paragraph (1).
