A The general secretary of the managing body of the Gtel in Seongbuk-gu, Sungnam-si, the president of the managing body, the defendant C and the defendant D are the above office managing director, the defendant C and the defendant D are the above office managing director, the defendant C from November 1, 2009 to April 30, 2013, and from July 2013, and the defendant D were working from February 2006 to October 31, 2009 and from May 1, 2013 to June 14, 2013 respectively for 546 households occupying the above officetel.

The Defendants’ co-principals organized the budget for all revenues and expenses for the management expenses as stipulated in the Officetel management rules, and conspired to use the fees for common use, parking fees, and telecommunications instruments rents, etc. of officetels for the maintenance and repair of officetels (hereinafter “incomes other than the management expenses”), but most occupants do not have much interest in operating officetels due to lessees, etc. who are not owners, and Defendant A exercises a strong influence on the management, maintenance, etc. of officetels, without undergoing accounting or audit on the revenues other than the above management expenses at the direction of the Defendant A, while keeping the revenues other than the above management expenses in the account under the name of the Defendant B, without being audited by the accounts or audit on the revenues other than the above management expenses, to be embezzled by the Defendants’ personal, management and management office employees, light investigation expenses, leave expenses, insurance expenses, oil expenses, etc.

On June 11, 2007, A, B, and D: (a) at the office of management of the above officetel; (b) Defendant D prepared a disbursement resolution for KRW 121,000 for the staff of the management office; (c) Defendant A and B approved in the above disbursement resolution; and (d) Defendant A and B withdrawn KRW 121,00 from the SCB bank account (L) in the name of the representative of the K Building Management Office B, which keeps parking fees and rents for telecommunications meters for the above officetel occupants, and then used for entertainment expenses around that time.
