A defendant shall be punished by imprisonment for not less than one year and six months.
However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The Defendant, while staying home under the influence of alcohol at around 04:00 on February 21, 2016 due to a debt relationship, such as in arrears with management expenses, credit cards, etc., was able to prevent fire by attaching a fire to the surrounding buildings, vehicles, goods, etc., which the Defendant was in his/her possession, without any special reason.
1. On February 21, 2016, the Defendant fire general goods: (a) around 04:26, 2016, at the front of the “D Animal Hospital” located in Dongbcheon-si, Dongbcheon-si, the Defendant installed a banner of the phrase “the overall maintenance of illegal floating advertisements” on both sides of the street at the victim Dongbcheon-si; and (b) on the ground that the banner interferes with traffic, the Defendant caused public danger by setting up the banner at the end of both ends of the banner with a single-use banner at one time.
2. On February 21, 2016, the Defendant fire a general motor vehicle: (a) around 04:35, 2016, the Defendant destroyed the said motor vehicle owned by the victim by setting the 2,168,043 won in aggregate of the repair cost to the front-time 2,168,043, by setting the cover gate installed at the loading of the said cargo onto the cover tent installed at the loading of the said cargo vehicle, on the ground that the said cargo would obstruct the passage of the said cargo vehicle, which was parked therein.
3. On February 21, 2016, at around 05:07, the general building fire Defendant came to a restaurant operated by the victim J in Dongducheon-si, the victim J, and then, at ordinary night, there is a complaint that the said restaurant is running a business by installing a tent up to the outdoor time due to the said restaurant, and the said restaurant is attached to the tent of plastic materials installed adjacent to the said restaurant, and the tent of such plastic materials as well as the air conditioners installed within the said tent.
