A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Criminal facts

On December 1, 2011, the Defendant: (a) transferred a e-mail card connected to the B bank account under the name of the Defendant to the bearer of the name; (b) however, the e-mail card was used for the crime of telephone financial fraud (hereinafter “scaming”); (c) and (d) was investigated by an investigative agency; (b) was aware on September 17, 2018, that if the e-mail card was sent to the Defendant’s name, the e-mail card could be used for the crime of scaming; and (c) consented with the proposal that “on September 17, 2018, if the e-mail card was sent, the e-mail will be kept up with the e-mail content, and then the e-mail card was sent to the e-mail account under the name of the Defendant, at around 17:00 of the same month, at around 17:00 of the same month.

On September 19, 2018, when the location of the Defendant is unknown, the Defendant received a remittance of KRW 6 million from the victim’s bank account (E) in the name of the Defendant on September 20, 2018 to the said bank account (E) in the name of the Defendant around September 20, 2018.

However, when the victim came to know of the fact of fraud, the victim requested the above D Bank account through a financial institution to suspend payment, and the staff of the Scam scam scam scam scam scam scam scam scam scam scam scam scam scam scam scam scams to the above 6 million won by communicating with the defendant

Accordingly, the Defendant visited D Bank's king points and transferred the above 6 million won to K bank account (M) in the name of K, the Defendant's seat, and received from K the above L Bank's check from K, and received the check from K, and received the check from K, and thereby made a TPPM at the king point of the L Bank.
