The plaintiff's claim is dismissed.

Litigation costs shall be borne by the plaintiff.

1. Facts of recognition;

A. The Defendant entered into an international marriage brokerage contract with the Plaintiff around April 10, 2017, with the trade name of “(State)C” as the person who is engaged in the international marriage brokerage business.

B. On April 24, 2017, the Defendant: (a) viewed the Plaintiff from Vietnam to be a woman of Vietnam, D, and thereafter, (b) had been engaged in marriage in Korea with the Plaintiff, and (c) thereafter D had been engaged in matrimonial engagement with the Plaintiff.

The plaintiff and D's conclusion of matrimonial engagement was reversed on November 2017.

C. On November 22, 2017, the Defendant, in Vietnam, had the Plaintiff look at the Plaintiff’s contact with the Vietnam female, E, and thereafter, had the Plaintiff enter into matrimonial engagement with the Plaintiff.

The conclusion of matrimonial engagement between the Plaintiff and E was reversed on January 2018.

On October 24, 2019, the Defendant was sentenced to a fine under the Daegu District Court Decision 2019 High Court Decision 201Da1295 on October 24, 2019 for the following criminal facts, and the Defendant appealed, but the judgment of conviction became final and conclusive.

The Defendant is a person who has operated an international marriage brokerage company from June 2015 to December 2017, with the trade name of “F and fourth-class Dispute Resolution Co., Ltd.”.

On April 10, 2017, the Defendant entered into an international marriage brokerage contract with A (44 years of age) a user.

Each international marriage broker shall obtain personal information, such as marriage history, health status, occupation, and criminal history, from a user who has entered into a contract and the other party to marriage brokerage, respectively, and shall provide the other party and the user with such information in writing.

2. Failure to provide personal information;

A. On April 26, 2017, the Defendant, around 14:00 on April 24, 2017, performed marriage brokerage by viewing D (V, Vietnam, 22 years of age), without providing in writing personal information and evidential documents on D, the other party to marriage brokerage, at a place in Vietnam, and without providing D (V, Vietnam, and 22 years of age) with the other party to marriage brokerage.

B. On November 22, 2017, the Defendant committed a crime against the Defendant on or around November 22, 2017 to E, who is the other party to marriage brokerage, at an infinite place in Vietnam on or around November 22, 2017.
