1. The Plaintiff:
A. The Defendants jointly pay 165,141,283 won;
B. Defendant B Co., Ltd. is 8,000.
Reasons
1. Basic facts
A. On August 28, 2012, the Plaintiff is only Defendant B Co., Ltd. (hereinafter “Defendant B”) on August 28, 2012.
(2) On December 28, 2012, the Plaintiff and Defendant B agreed to change the construction cost to KRW 618,00,000,000 for the construction cost, and KRW 60,000 for the construction period from the contract date. 2) The Plaintiff and Defendant B agreed to change the construction cost for the manufacture and installation of high-pressure gas production facilities, such as KRW 1,83,00,000 for the storage tank 4 high-pressure gas storage tank (in oxygen, known difficulty, nitrogen, and carbon acid), and the construction period to December 28, 2012, and KRW 197,00,00 for the construction cost for the extension of the building (in addition to value-added tax), and KRW 197,00,000 for the construction cost for the extension of the building (in the case of the construction of high-pressure gas, the Plaintiff and Defendant B agreed to change the construction cost to the manufacturing facility of the Plaintiff as the contractor, respectively, and Plaintiff E agreement for the extension of the building.
(3) Meanwhile, on October 8, 2012, Defendant B subcontracted to Defendant C Co., Ltd. (hereinafter “Defendant C”) the subcontract price of KRW 213 billion (excluding value-added tax) and the delivery period of the above high-pressure gas storage tank 4 equipment with a fixed period of not more than 30 days from the contract date. Defendant C supplied 4 high-pressure gas storage tank equipment (hereinafter “instant high-pressure gas storage tank”) to Defendant C on November 201 under the said subcontract.
4) By December 20, 2012, Defendant B completed the construction of expansion of the building of high-pressure gas manufacturing factory operated by the Plaintiff, and Defendant B installed the instant high-pressure gas storage tank supplied by Defendant C to the above high-pressure gas manufacturing factory. (B) On the other hand, the Plaintiff was a criminal case proceeding due to the certificate of passing the inspection of high-pressure gas storage tank and the forgery of the name plate.
