피고인은 창원시 마산회원구 B 1층 소재 ‘C’의 대표로 2013. 7. 18.부터 개똥쑥 건초, 개똥쑥 환, 개똥쑥 진액을 판매하는 사람이다.

No one shall indicate or advertise that foods have efficacy or effect in preventing and treating diseases, or that foods are likely to be mistaken for or confused as medicine or functional health foods.

피고인은 2013. 10.경부터 2014. 9. 2.경까지 ‘C’이라는 네이버 블로그(D)를 개설하여 “C 직송 창원판매점, 항암효과 1,200배, 개똥쑥환, 개똥쑥즙, 고혈압, 당뇨, 혈압개선”, “최근엔 개똥쑥의 추출물이 항산화와 암세포를 억제하는 효과가 탁월하다는 연구결과가 나오면서 전남 곡성, 경남 산청, 강원도 등 농가의 신소득 작물로 부상하고 있다”라는 내용을 게재하고 아울러 위 건물 1층 입구 유리창에 “개똥쑥 효능 항암효과 1,200배, 당뇨, 고혈압, 고지혈증, 면역력 증강, 피로회복, 간기능향상, 위암, 위염 소화불량, 수족냉증, 여성의 자궁, 정혈작용, 변비(숙변제거)에 탁월”이라는 내용의 광고물을 부착하였다.
