A defendant shall be punished by imprisonment for not more than ten months.
Reasons
Punishment of the crime
1. Fraud;
A. On October 15, 2010, the Defendant, at the Defendant’s office located in Gwanak-gu, Seoul Special Metropolitan City around October 15, 2010, issued to the victim D a false statement that “B is a person who solicits the investment of Samsung Securities to act as an agent for the investment of Samsung Securities, and the return to pay an investment well, is at least 384%. B. Around November 24, 2010, the Defendant would offer a profit at least 15% of the principal amount through stock investment by putting 30 million won into the deposit deposit account and 30 million won into the account of the Defendant’s new bank on November 24, 2010.”
However, even if the defendant receives money from the victim, the defendant did not have an intention or ability to return or promise the principal.
B. On March 4, 2011, the Defendant, at the Defendant’s office, transferred KRW 10 million from the Defendant’s agricultural bank account to the Defendant’s agricultural bank account on April 4, 2011, on the following grounds: (a) the Defendant made a false statement to the effect that “B is not in the form of Samsung Securities.” (b) When opening a securities account to Samsung Securities and assigning KRW 10 million to B, not only guarantee of principal, but also payment of the profits amounting to at least 15% to 20% of principal amount from the following month the money was deposited.
However, even if the defendant receives money from the victim, the defendant did not have an intention or ability to return or promise the principal.
2. Around December 16, 2010, the Defendant leased and operated the 84,593,986 won of the principal and interest each month from January 20, 201 to April 42, 201, on the condition that the 1,612,494 won and the 1,53333 won and interest were paid each month during the period from January 20, 201 to April 42, 201, the FMW 328i car owned by the victim (the victim) at the Cululula Daejeon Daejeon Daejeon Daejeon Branch, a sales and cooperation store of the Culula Capital, and the said principal and interest were reserved by the victim until all of the aforementioned principal and interest were paid to the victim.
