1. The Plaintiff:

A. As to the Defendant A and C’s joint and several KRW 102,303,199 and KRW 100,96,575 among them, Defendant A and C’s joint and several liability.

1. Facts of recognition;

A. On September 26, 2012, the Plaintiff concluded a credit guarantee agreement with Defendant A Co., Ltd. (hereinafter “A”), and B (hereinafter “B”) on September 26, 2012, with respect to loans that the said Defendants would receive from each national bank, as follows. Defendant C jointly and severally guaranteed the liability for indemnity that Defendant A and B owes to the Plaintiff according to the said credit guarantee agreement. On that day, Defendant A and Defendant B were loaned KRW 100 million to Defendant B, and KRW 200 million from each national bank.

On September 25, 2013, the Plaintiff and the Defendants agreed to change the respective term of guarantee under the aforementioned credit guarantee agreement to September 26, 2014.

B. 1) The occurrence of a guarantee accident and the Plaintiff’s subrogation by the Defendant B, on March 23, 2014, shall be subject to the “first guarantee accident” (hereinafter “first guarantee accident”).

Defendant A, on July 1, 2014, is due to a natural body (hereinafter “No. 2 Guarantee Accident”).

(2) Each national bank has lost the benefit of time due to the repayment of the obligation to pay the loan to each national bank. The Plaintiff paid to the national bank the principal of KRW 174,423,334 with respect to the guarantee obligation on June 26, 2014 (principal KRW 170 million, interest KRW 423,334), and the principal and interest of KRW 100,96,575 with respect to the guarantee obligation on August 19, 2014 (principal KRW 10,000,966, interest KRW 96,575) with respect to the guarantee obligation on June 26, 2014.
