A defendant shall be punished by imprisonment for one year.
Reasons
Punishment of the crime
On February 7, 2017, the Defendant was sentenced to a suspended sentence of two years and a fine of ten million won at the Seoul Central District Court on October 15, 2017. On July 6, 2017, the Defendant was sentenced to a suspended sentence of two years for the violation of the Act on the Punishment of Arrangement of Commercial Sex Acts, Etc. and the judgment became final and conclusive on July 14, 2017. However, on July 14, 2017, the Seoul Central District Court sentenced imprisonment of two years for the violation of the Act on the Punishment of Specific Crimes, etc. of Commercial Sex Acts, Etc. and revoked the suspended sentence on July 14, 2017, and completed the execution of the sentence by the Seoul Southern District Court on November 10, 2018.
1. Around June 23, 2019, the Defendant interfered with the business of the victim’s hotel at the D hotel where the victim C works in Jeju City, on June 23, 2019. Around 23:50, the Defendant interfered with the victim’s hotel operation by force by demanding that the victim “self-employed E make a free request for the hotel room,” and that the victim should obtain permission from F, which is the head of the guest room team, delayed time for the victim’s delay, thereby interfering with the victim’s hotel operation.
2. On June 23, 2019, at the above D hotel around 23:50 on June 23, 2019, the Defendant destroyed the property owned by the victim, on the grounds as set forth in paragraph (1), by leaving a stand stand for information of aluminium materials owned by the victim D hotel toward the entrance of the hotel, leaving the entrance door at a part of the entrance, and leaving a funeral room attached to a wall with a small table on the street, thereby making it difficult to know the market price due to defects in the decoration.
3. Injury;
A. The Defendant, around 00:05 on June 24, 2019, was the victim’s losses on the ground that the victim F (the age of 51) got late to assign the hotel room to the Defendant as described in paragraph (1).
