A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The defendant of "2014 Highest 2259" is the owner who runs the shipbuilding design service business as the representative director of the (ju)BK in Yeongdeungpo-gu Seoul Metropolitan Government, and as the representative director of the (ju) 2M in Busan Jung-gu, 301.
From March 1, 2012 to January 15, 2014, the Defendant, while working in the said Note, did not pay 139,778,320 won, including the total of 16,689,960 won of wages and retirement allowances of retired workers BN, as stated in attached Form 1, within 14 days from the date of retirement, without any agreement between the parties on the extension of the due date.
The defendant of "2014 Highest 3920" is a representative director of BM located in Busan Jung-gu, Busan, who is engaged in shipbuilding and design service business.
The Defendant is working at the same workplace from April 2, 2012 to March 11, 2014.
Without agreement on the extension of the due date for payment between the parties, 4,424,210 won of wages and retirement allowances of the retired victim BO was not paid within 14 days from the date of retirement of the above BO, and without agreement on the extension of the due date for payment between the parties, 78,258,870 won in total for two victims, such as the list B of crimes in the attached Table B, were not paid within 14 days from the date of retirement of the victims.
The Defendant is the employer who is engaged in the shipbuilding design service business, employing 18 full-time workers under the trade name of Busan Jung-gu BL and 301 "BM of a stock company."
The Defendant did not pay the total amount of KRW 27,093,060, including the total amount of KRW 19,850,380, and retirement allowances, KRW 7,242,680, and the total amount of KRW 27,093,060 of the wages of retired workers from the said workplace from October 4, 201 to March 31, 2014, and the Defendant did not pay the wages and retirement allowances of KRW 9 within 14 days from the date of retirement, as described in attached Table No. 3.
