A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[criminal history] On June 27, 2012, the Defendant received a summary order of a fine of three million won for a violation of the Road Traffic Act (drinking driving) at the Seoul Central District Court on the part of June 27, 2012. On August 12, 2016, the Defendant received a summary order of a fine of four million won for a violation of the Road Traffic Act (drinking driving) at the Sungnam Branch Branch of the Suwon Branch of Seoul District Court, and on March 24, 2017, issued a summary order of seven million won for a violation of the Road Traffic Act (drinking driving without a license).

[Criminal facts]

1. On January 5, 2017, the Defendant violated the Road Traffic Act (drinking driving) and the Road Traffic Act (Dless driving) on the following occasions: (a) was under the influence of alcohol for about 10km between the 00:25 and the 56-lane south of the same west and the 56-lane south of the same west; (b) was under the influence of alcohol for about 0.108% in blood without a driver’s license; and (c) was under the influence of alcohol for about 0.108% in blood; and (d) driven a halog car owned by B.

As a result, the Defendant violated the prohibition on drinking at least twice, and drives a motor vehicle without obtaining a driver's license under the influence of alcohol.

2. Violation of the Act on Special Cases concerning the Settlement of Traffic Accidents (Bodily Injury) is a person who is engaged in driving a halog car owned by B.

At the date and time set forth in the above paragraph 1, Defendant 1 driven the above car and driven the road of the 3-lane 56-lane South west-do along the entrance of the 56-lane south-west-west-west-si, Gyeonggi-do along one-lane from the south bank to the Seoul bank. The above west left the road at the one-lane west-gu, the south bank left the west bank.
