1. The instant lawsuit shall be dismissed.

1. Basic facts

A. On September 6, 2002, the provisional registration of the principal registration and the cancellation of the plaintiff's transfer registration (i.e., the provisional registration of this case) was completed on September 6, 2002, with respect to the ownership transfer registration of the new GazS Co., Ltd. with respect to the 1/2 share of the 1/2 share on the same day, the provisional registration of the right to claim ownership transfer registration (hereinafter the provisional registration of this case) was completed in the defendant's future with respect to the remainder of 1/2 share (the shares 235.4/470.8 share; hereinafter the same shall apply).

As to the portion of 33.058/470.8 of the newly held shares on November 13, 2002, the ownership transfer registration has been completed in the name of the plaintiff (hereinafter the plaintiff's transfer registration), and as to the portion of 16.53/470.8 out of the remaining portion of 101.171/235.4 shares of November 27, 2002, D, on November 25, 2002, the provisional registration of the right to claim the transfer of ownership was completed on November 25, 2002.

On December 5, 2002, the registration of the transfer of the plaintiff was cancelled on the ground that the principal registration based on the provisional registration of the defendant (hereinafter the principal registration of this case) was completed.

On October 16, 2008, the Seoul Central District Court rendered a judgment ordering cancellation of the principal registration of this case on the ground that the provisional registration of this case was completed without undergoing the liquidation procedure as a provisional registration for security, and the provisional registration of this case became final and conclusive on February 6, 2009, the principal registration of this case was cancelled on November 2, 2009.

The provisional registration of this case and the transfer registration of ownership completed in the future of the plaintiff in respect of the shares 33.058/470.8, which were new shares as of the time of Sheshed, had been completed in the future.

However, the restoration registration of the plaintiff was not completed.
