피고인은 2014. 12. 31. 02:30경부터 같은 날 02:58경까지 술에 취하여 위 주점의 출입문을 발과 주먹으로 수회 걷어차고, 주점 내에 다른 손님들이 있음에도 불구하고 큰 소리로 "씹팔 좃 같네"등 욕을 하는 등으로 위력을 행사하여 이에 손님들이 겁을 먹고 나가게 하는 등 약 30분간 위력으로써 피해자의 주점 영업 업무를 방해하였다.
