Defendant
A shall be punished by a fine of KRW 300,00, and by a fine of KRW 1,500,000, respectively.
The above fines are imposed by the Defendants.
Reasons
Punishment of the crime
Defendant
A is a person who is a director E Accounting Division in Gyeyang-gu Incheon, and Defendant B is a person who performs a work of paying the tuition fees for a private teaching institute to F, a corporation whose head office is the head office, after obtaining tuition fees from students as the head office of the above branch administration office.
1. The Defendants conspired with each other,
A. A. Around July 5, 201, at the above E Accounting Division, which was directly operated by F, the victim company F, a victim company, received tuition fees of KRW 185,000 from the above student G from the above educational institute student G and did not deposit it to the victim company while keeping it for business purposes, and around that time, until December 8, 2011, the aforementioned amount was embezzled by depositing KRW 5,444,00 in total over 23 times as shown in the attached crime list 1, as shown in the attached Table 1, from around that time to December 8, 2011.
B. On July 25, 201, at the above calculated cost, when the Plaintiff received tuition fees of KRW 202,00 from the student H in cash from the student H, he/she shall deposit the amount to the head office, despite having to deposit it, he/she shall report it to the head office with the said H’s card approved by the other student I, and he/she shall report it to the head office with the said H’s card; and I embezzled KRW 2,90,000 by December 2, 201, including when he/she arbitrarily used the tuition fees of KRW 202,00 paid in cash in the manner of omitting the monthly sales report.
2. Defendant B:
(a) on August 16, 201, the said money is embezzled in a manner that arbitrarily uses 50,000 won for subordinate staff members who were in custody of tuition fees received from original students at the above office of the cost of calculation;
(b) The same year;
8. 20. 20. At the place described in paragraph 2(a), 150,000 won for tuition fees in the same manner as described in paragraph 2(a) shall be used at will from the above J;
(c) The same year;
9.1. At the place described in paragraph 2(a), 50,000 tuition fees shall be used at will by taking out 50,000 won from the above J in the same manner as described in paragraph 2(a).
