1. The Defendants: (a) KRW 60,000,000 for each Plaintiff and 5% per annum from April 5, 2016 to July 18, 2017.

1. Occurrence of liability for damages;

A. At around 5:50 on April 5, 2016, D, E (fishing vessel number: F; hereinafter “instant vessel”) is a vessel for coastal improvement and e (fishing vessel number: F; hereinafter “instant vessel”).

(A) A crew member of the same day, who was engaged in fishing at the sea of 2.2 e.g., the Jinjin-gu, Incheon, Spoon-si, Yan-gu, Incheon, on the 12:50th day, went to the port side of the vessel, and went to the port side of the starboard side of the vessel, and accordingly died due to the divers and e.g., the instant accident (hereinafter “instant accident”).

(2) The Plaintiff is the sole heir as the spouse of D (hereinafter “the deceased”). The Defendants are the owner of the instant vessel (owner), and Nonparty G are the captain of the instant vessel.

3 인천지방법원은 2017. 1. 19. 이 사건 선박의 선장인 G에 대하여 2016고단3642호로 'G은 이 사건 사고 일시 무렵 미리 해저에 투망해 놓은 안강망 엥카 닻줄을 갑판 선수부 우현에 설치된 양망기를 이용해 갑판 위로 끌어올리는 작업을 하고 있었는데, 이러한 경우 작업 및 선원 등의 안전관리 책임자인 G으로서는 선수부 갑판 선원들이 양망작업 등 위험한 작업을 하고 있을 때에는 작업의 방해가 될 만한 물건 등을 안전한 장소로 이동시키고, 선수부 우현 갑판에 설치된 양망기 사이에 닻줄을 끼워 갑판으로 올리는 작업을 하는 망인에게 작업 전 안전교육을 철저히 시키며, 양망기를 조작하는 선원의 작업 상황을 면밀히 관찰하여 양망작업 중 사고가 발생하는 등의 의심스러운 상황이 발생하기 전 조타실에 설치된 양망기 전원 스위치를 직접 작동하는 등으로 안전사고가 발생하지 않도록 하여야 할 업무상 주의의무가 있다.

Nevertheless, G is negligent in doing so, and G is 30cm in the front of the steering house, with the fishing gear and the load on the deck.
