A defendant shall be punished by imprisonment for not less than one year and six months.

The defendant shall be ordered to complete 40 hours of sexual assault treatment lectures.

Punishment of the crime

On April 15, 2018, between 00:00 and 01:00, the Defendant: (a) in the “C” singing room located in Daejeon Pungdong-gu B; (b) through the “group D room”, and (c) while playing in singing together with the victim E (the name, the name, and the age of 20) who was aware of only online; and (d) while playing in singing, the Defendant’s sexual organ was taken out of the Defendant’s sexual organ.

어 빨아 줄 것을 요구하고, 깜짝 놀란 피해자가 이를 거절하자 손으로 피해자의 머리채를 잡아 강제로 피고인의 성기 가까이에 대고 눌러 피해자의 입안으로 피고인의 성기를 집어넣고, 피해자를 소파에 눕혀 그 위에서 피고인의 몸으로 누르고 피해자의 양 손목을 붙잡는 등으로 폭행하여 피해자의 반항을 억압한 다음 피해자의 바지와 속옷을 벗기고 손가락을 피해자의 질 내부에 삽입하고, 계속하여 피고인의 성기를 피해자의 질에 삽입하여 피해자를 강간하려고 하였으나 피해자가 울면서 몸부림을 치는 등 강하게 저항하는 바람에 그 뜻을 이루지 못하고 미수에 그쳤다.
