1. Defendant A shall be punished by imprisonment for eight months.

Punishment of the crime

The Defendants are siblings who are engaged in the construction business with the trade name “E” in Busan-gu Da, and the victim C is a person who requested the Defendants to remodel the residence of the victim in Seo-gu, Busan-gu.

On June 17, 2016, the Defendants decided to complete the construction by July 31, 2017 upon receiving the request from the victim for the said construction work and paid KRW 22,700,000 from the victim for several times until August 23, 2016. However, the Defendants failed to perform the sn beam installation of the sn beam and the floor part of the construction and to observe the date of completion promised to the victim.

On August 24, 2016, Defendants prepared a written statement of performance with the victim’s completion of construction until September 7, 2016, stating that “The construction work will be completed until September 7, 2016, because the cost of purchase of materials is required to change the construction cost.” On October 21, 2016, Defendants drafted a false statement of performance with the victim’s completion of construction by November 11, 2016.”

However, the Defendants did not have the intent or ability to complete the construction work even if the Defendants received the construction cost from the victims because the Defendants used the Defendant’s repayment of personal debt, such as the Defendant’s bond, and used the 3,800,000 won for the purchase of the necessary board at another construction site.

around August 31, 2016, the Defendants received 800,000 won from the victim for the purchase of materials from the H bank account under the name of the Defendant G, the son of Defendant A, as the purchase price of materials, and the same year.
