A defendant shall be punished by imprisonment for two years.
Reasons
Punishment of the crime
In September 2012, the Defendant stated that “The Defendant would make a 1.5 million won- or 2.7 million won- or KRW 1.5 million- or KRW 2.7 million- or KRW 1.7 million- or KRW 1.5 million- or KRW 1.5 million- or KRW 2.7 million- or KRW 2.7 million- or KRW 1.5 million- or KRW 35 days- or more-7 million- or more-out profit is paid to the Victim E in the D entertainment tavern located in Busan Shipping Daegu Daegu.”
However, in fact, the defendant did not purchase and sell used buses, and tried to pay interest on other borrowed money with borrowed money from the victim.
As above, the Defendant received KRW 20,000,000 from October 17, 2012 to the Defendant’s national bank account (Account Number:F) from the Defendant’s national bank account on October 17, 2012, by deceiving the victim as above, and received KRW 1,395,30,300,000 in total over 70 times from October 17, 2012 to January 17, 2013, as shown in attached Table 1.

The Defendant, through G at a place where a place is unknown in December 2012, through G, expressed to the victim H that “The Defendant purchased a heavy truck of KRW 33 million and sold it to the medium and medium-sized market with KRW 7 million.” The Defendant stated to the effect that “The Defendant would buy and sell a high-speed truck of KRW 33 million.”
However, the defendant did not purchase and sell used trucks, and even if he received money from the victim, he did not want to buy used trucks and sell them.
As above, the Defendant, by deceiving the victim, was transferred from the victim on January 11, 2013, KRW 50 million, KRW 26 million on December 12, 201 of the same month, KRW 30 million on the 14th of the same month, KRW 37 million on the 18th of the same month, KRW 47 million on the 22th of the same month, and KRW 190 million on the 197th of the same month, to the Defendant’s national bank account.
2. The Defendant was the victim at the package in which it is impossible to identify the trade name in the Seo-gu, Seo-gu, Busan around November 2012.
