All appeals by prosecutors are dismissed.

1. Summary of grounds for appeal;

A. Defendant 1) recognized that the lower court committed an indecent act against the victim. However, in light of the fact that the Defendant’s left hand hand over at the time of the instant case, and the victim continued to sit without getting out of the place, the fact that the Defendant’s hand over in the subway was sucks and contacted the victim’s hand over, but the Defendant did not commit an indecent act by intentionally rhing the victim’s hand on several occasions. Therefore, the lower court’s judgment convicting the Defendant of the facts charged in the instant case, which affected the conclusion of the judgment, is erroneous by misapprehending the fact that the Defendant committed an indecent act.

Even if the judgment of the court below is unfair, the punishment (the fine of 2 million won, the completion of the sexual assault treatment program 40 hours) of the judgment of the court below is too unreasonable.

B. The form of the lower judgment by the prosecutor is too uneasible and unreasonable.

2. Determination:

가. 피고인의 사실오인 주장에 관한 판단 살피건대, 원심 및 당심이 적법하게 채택하여 조사한 증거들에 의하여 인정되는 다음과 같은 사정들, 즉 ① 이 사건 당시 피고인과 피해자의 모습을 촬영한 CD영상에 의하면, 피고인이 앉아 있는 자세가 피해자 쪽으로 훨씬 밀착되어 있고, 그로 인하여 피고인의 왼쪽 어깨가 피해자 쪽으로 상당히 기울어져 있는 등 피고인의 자세가 어색해 보이는 점, ② 피고인의 오른손은 무릎 위에 있는 반면, 왼손은 가방에 의해 상당 부분 가려져 있고, 피고인 및 변호인이 주장하는 바와 같이 피고인의 왼손 엄지손가락이 가방 위로 걸쳐져 있다고 하더라도 새끼손가락으로 피해자의 오른쪽 허벅지를 만지거나 더듬는 것이 충분히 가능해 보이는 점, ③ 피고인이 피해자의 허벅지를 더듬는 순간 피해자가 순간적으로 여러 번 눈을 깜빡이면서 반응한 점, ④ 피해자는 경찰 이래 원심 법정에 이르기까지 피고인이...
