A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for two years from the date of the final judgment.

Punishment of the crime

1. Around 01:00 on August 27, 2013, the Defendant: (a) around 01:0, the Defendant: (b) placed the victim D’s 2 room of the “Enopode” in the Manopo-si, Changwon-si, Mapo-si, Changwon-si; (c) placed an order to pay the victim the alcohol value.

However, the defendant did not have the intention or ability to pay the drinking value.

Nevertheless, the Defendant, by deceiving the victim as above, was provided with alcoholic beverages equivalent to KRW 400,00,000 in total, namely, two soldiers in Scarblus (17.0) and Aboblus (17.0) from the victim.

2. 폭력행위등처벌에관한법률위반(집단ㆍ흉기등상해), 폭력행위등처벌에관한법률위반(집단ㆍ흉기등폭행) 피고인은 2013. 8. 27. 03:15경 위 장소에서 피해자 D(여, 56세)으로부터 술값 계산을 요구받자 술값이 많이 나왔다는 이유로 그 곳 테이블 위에 놓여 있던 위험한 물건인 양주병을 집어 들어 위 D의 얼굴을 2회 때리고, 룸에서 나가는 D을 뒤따라가 주방에서 빈 맥주병을 집어들고 D을 향하여 던진 다음, D의 비명 소리를 듣고 찾아온 피해자 F(47세)가 피고인을 제지하자, 그 곳 테이블 위에 놓여있던 위험한 물건인 맥주병을 집어 들어 위 F의 머리를 1회 내리치고, 발로낭심을 1회 걷어찼다.

As a result, the defendant carried dangerous things with the victim D and committed an assault against the victim F.

3. On August 27, 2013, the Defendant: (a) expressed to the Defendant that the security guards belonging to the Mountainous District G District in the Mapo-gu Police Station G District sent to the Defendant after receiving a report at the above location on August 27, 2013; (b) expressed to the said H that “Chewing flachip, Nice police officers shall open, die, etc.”; and (c) expressed to the said H that “H’s buck part was walkinging twice in the buckbuck part; and (d) sprinking down the upper clothes.”

Accordingly, the defendant interfered with the legitimate performance of duties by police officers.
